Tujuan dan Isi Dekrit Presiden 5 Juli 1959 Lengkap - Pada pembahasan kali ini kita akan membahas mengenai "Dekrit Presiden" yang dikeluarkan oleh presiden pertama Republik Indonesia yakni Ir. Soekarno. Sub tema yang akan kita bahas mencakup isi dekrit presiden, pengertian, latar belakang, tujuan, dan dampak / pengaruh. Dekrit presiden yaitu sebuah keputusan, perintah atau ketentuan yang dikeluarkan oleh presiden atau kepala negara apabila terjadi problem yang darurat dalam sebuah negara.

Latar belakang Dekrit Presiden 5 Juli 1959 disebabkan lantaran gagalnya Badan Konstituante untuk menciptakan Undang-Undang Dasar baru. Bandan ini dibuat pada tahun 1955 dengan tujuan membentuk Undang-Undang Dasar gres menggantikan UUDS tahun 1950 dengan melaksanakan beberapa kali sidang, tetapi jadinya hingga tahun 1958 Undang-Undang Dasar gres tersebut belum juga dirumuskan. Akibat belum juga merumuskan Undang-Undang Dasar baru, kemudian Ir. Soekarno hadir pada sidang Konstituante yang berlangsung pada tanggal 22 April 1959. Pada sidang tersebut, Presiden Soekarno kemudian berbicara didepan para anggota yang hadir, ia mengusulkan biar kembali ke Undang-undang Dasar 1945.

Usulan Presiden Soekarno kemudian ditanggapi oleh Dewan Konstituante dengan melaksanakan pemungutan bunyi pada tanggal 30 Mei tahun 1959. Hasil dari pemungutan bunyi tersebut yaitu sebanyak 199 bunyi tidak oke terkait dengan kembalinya ke Undang-Undang Dasar 1945, sementara yang oke berjumlah 269 suara. Pada pemungutan tersebut ternyata keputusannya tidak sah, hal ini dikarenakan jumlah anggota yang hadir tidak melebihi jumlah minimum ketentuan yang berlaku untuk legalisasi keputusan, sehingga terpaksa harus melaksanakan pemungutan bunyi ulang pada pertemuan selanjutnya.

Pemungutan bunyi sebelum Dekrit Presiden 1959 dilakukan kembali pada tanggal 1-2 Juni tahun 1959. Tetapi ternyata jumlah anggota yang hadir tetap saja kurang, hal ini kemudian memunculkan kecemasan dikalangan masyarakat maupun pemerintah. Pemerintah kemudian melaksanakan langkah dengan pelarangan kegiatan politik, perintah tersebut disampaikan oleh A.H Nasution yang merupakan kepala KSAD (Staf Angkatan Darat). Larangan tersebut dikeluarkan melalui Peprpu No.040 tahun 1959. Sementara itu, Suwirjo (ketua PNI) mengirim surat kepada Ir Soekarno biar membubarkan Konstituante dan mengembalikan Undang-Undang Dasar 1945 sebagai pengganti UUDS.

Akibat lamanya perumusan Undang-Undang Dasar gres untuk menggantikan UUDS 1950, kemudian situasi politik semakin panas. Di kawasan mulai muncul gerakan separatisme, ibarat pembentukan Dewan Garuda, Dewan Gajah, Dewan Banteng dan Dewan Manguni. Beberapa kawasan yang terjadi pergolakan separatisme membentuk pemerintahan sendiri dan secara tegas tidak mengakui kedaulatan pemerintah pusat. Gerakan separatisme yang cukup mengancam kedaulatan Indonesia yakni PRRI (Sumatera) dan Premesta (Sulawesi Utara).

Kegagalan dewan konstituante kemudian mencapai puncaknya pada Juni 1959 dengan ditandai dengan beberapa kejadian politik yang mengancam kedaulatan Republik Indonesia. Kemudian untuk keselamatan negara, Ir Soekarno selaku Presiden Indonesia pada Minggu tanggal 5 Juni 1959 sempurna pada jam 5 sore, ia mengeluarkan dekrit / perintah pada upacara resmi di Istana Negara. Isi Dekrit Presiden 5 Juli 1959

Dekrit presiden yang dikeluarkan oleh Ir Soekarno pada tanggal 5 Juli 1959 memuat beberapa poin-poin penting. Berikut ini isi dekrit presiden secara singkat :
  1. UUD 1945 kembali berlaku.
  2. Pembubaran Konstituante.
  3. UUDS 1950 tidak dipakai / tidak berlaku lagi.
  4. Pembentukan DPAS dan MPRS
Dekrit yang dikeluarkan Presiden pada tanggal 5 Juli 1959 ternyata menerima sambutan baik dari masyarakat. Hal ini lantaran selama hampir 10 tahun masyarakat hidup dalam kegoyahan zaman Liberal dan mendambakan adanya kestabilan politik. Drikeit tersebut juga diakui dan diperkuat oleh Mahkamah Agung, serta didukung oleh AH Nasution (ketua KSAD) yang merupakan salah satu konseptor dekrit tersebut.

Dengan dikeluarkannya Dekrit Presiden, kemudian Kabinet Djuanda dibubarkan sempurna pada tanggal 9 Juli 1959 dan digantikan dengan Kabinet Kerja. Susunan anggota kabinet ini mencakup : perdana menteri yaitu Ir Soekarno, sementara Ir Djuanda menjabat sebagai menteri pertama. Program kerja kabinet ini mencakup pembebasan Irian Barat, penguatan sandang pangan dan pembebasan Irian Jaya.

Berikut ini beberapa alasan dikeluarkannya Dekrit Presiden 5 Juli 1959, antara lain :
  • Situasi politik semakin jelek dan kacau.
  • Munculnya beberapa gerakan separatisme yang mengancam kedaulatan negara.
  • Lamanya pembuatan Undang-Undang Dasar gres oleh Konstituante, sementara UUDS dianggap tidak sesuai dengan kondisi masyarakat RI.
  • Partai politik lebih mementingkan tujuannya dengan melaksanakan segala cara.
  • Terdapat banyak sekali perbedaan pendapat dalam Parlemen.

Tujuan Dekrit Presiden yaitu untuk menuntaskan problem yang muncul akhir ketidakjelasan terkait dengan pembuatan Undang-Undang Dasar baru, sehingga dekrit tersebut dibutuhkan sanggup menyelamatkan Indonesia dari banyak sekali bahaya yang ada. Sementara itu, berikut ini beberapa dampak dari dekrit presiden 5 Juli 1959. Dampak tersebut mencakup dampak positif dan negatif.

Dampak positif dari Dekrit Presiden yang dikeluarkan yaitu kembalinya Undang-Undang Dasar 1945 sanggup memperlihatkan ajaran yang terperinci terkait dengan kelangsungan negara, menuntaskan krisis politik dan perpecahan yang semakin berkembang, kemudian sanggup memulai pembentukan MPRS dan DPAS yang merupakan forum tinggi suatu negara.

Sementara itu, dampak negatif dari Dekrit Presiden 5 Juli 1959 yaitu kekuasaan forum tinggi negara termasuk Presiden semakin besar, munculnya kekuatan gres dalam bidang politik yakni kekuatan militer, kemudian pelaksanaan Undang-Undang Dasar 1945 tidak konsisten dan hanya menjadi slogan kosong saja.
